Presenting complex digital evidence in a compelling way in court to a jury, 28 April 2027

Our workshop considers the challenges, pitfalls and best practice around presenting complex digital evidence in a compelling way in court to a jury.

We will look at why complex digital evidence can be difficult for non-technical audiences to understand. With this in mind, we will then identify effective methods of presenting timelines, communications, locations, device activity and other digital evidence.

We will look at how to distinguish between factual findings, analytical interpretation and assumptions and recognise the importance of evidential limitations, disclosure, continuity and accuracy.

The workshop will also provide best practice around how to structure digital evidence to support the prosecution or defence in understanding the issues in dispute.

It is aimed and investigators and analysts who want to develop and enhance their skills and knowledge around presenting their work to a jury in court.

Outline of the Day

Introduction to the key considerations and challenges around presenting digital evidence in court. Understanding the audience.

Consideration as to why jurors may struggle with IP addresses, cell-site evidence, metadata, cloud records, digital timestamps and technical forensic terminology. Introduce the importance of plain English, clear explanations and avoiding unnecessary jargon.

Making digital evidence understandable

Best practice around how to translate technical findings into accessible language, distinguish what a device recorded from what it proves about a person, explain time zones and data provenance, and communicate uncertainty without undermining the value of reliable findings.

Effective visual presentation

We look at how to produce chronological timelines, show the sequence of relevant events and identify gaps or conflicting records. We will look at how to use pictures and models to help a jury understand the use of demonstrative evidence.

We will look at what location records indicate, including their limitations and accuracy and how a picture is worth a thousand pieces of evidence.

We will also look at communications evidence, how to present conversations in context, preserving sender, recipient, date and source details, association and link charts, illustrate connections while distinguishing confirmed relationships from hypotheses.

How to Create a compelling evidential narrative

We will introduce a structured approach: identify the evidential question, establish what the data shows, explain how it was obtained, present its significance, and address alternative explanations. Emphasise that compelling evidence must remain impartial, proportionate and supported by the underlying records.

Key lessons

Conclude with the importance of clarity, consistency, provenance, visual accuracy, technical validation and preparation for questioning in court.
