Workshop explores best practice, challenges and pitfalls around the removal of sensitive digital information from disclosed documents, ensuring compliance with legal obligations.

The redaction regime requires ensuring that confidential data, such as personal identifiers, trade secrets, or classified materials, is protected while maintaining the integrity of the evidence.

The process of often fraught with confusion and misinterpretation. The aim of the workshop is to demystify commonly misunderstandings and build skills and best practice.

The day will include

Session One: Key Principles and Best Practice

  • An introduction to the legal and ethical reasons why redaction is carried out including a consideration of GDPR and the Data Protection Act.

  • An explanation of what we redact – sensitive and personal sensitive information.

  • Examples of Redaction, and how it is required for the purpose of investigations.

  • A consideration of Disclosure Obligations vs protection of sensitive data

 

An outline of What constitutes Digital Material

Material that may need redacting:

  • Documents

  • Audio/Visual/Images

  • Social Media

  • Messages

  • Body Worn/CCTV

 

Risks and Challenges

A Look into the most common issues

  • Incomplete Redaction

  • Technological limitations

  • Under/Over Redaction.

 

Session Two: Digital Redaction in Practice

  • Devising your Strategy: where to Start

  • Decisions from the outset lead to consistency

  • Quality Assurance

  • Discussion with stakeholders before it is implemented

Our speaker

The workshop will be led by Jocelyn Lodge, an experienced barrister who has worked for a law enforcement organisation advising on disclosure strategies on a number of complex investigations where disclosure obligations have been challenging.
